Customary law has generally been described as a body of rules, customs, or traditions, considered binding upon them by the people or community to whom they refer. There is, however, no universally recognized definition of customary law, a term viewed by many as problematic. Its connection with ‘custom’ has, for example, been described as potentially confusing and suggestive of a wide range of traditional behaviours some of which ‘have nothing whatever to do with law’.
